1. General


1.1 These Terms and Conditions ("Terms") govern the relationship between Counsellorsandpsychotherapists.co.uk and you, the Website User.


1.2 These Terms may be changed without prior notice at any time.  You should check the Website from time to time to review the then current legal notice, because it is binding on you. Certain provisions of this legal notice may be superseded by expressly designated legal notices or terms located on particular pages at the Website.


1.3 By using this Website, whether or not you make any engagement with any practitioner listed on the Website, means that you have understood and accepted these terms.


2. Defined Terms


Counsellorsandpsychotherapists.co.uk means the company that controls the Website, being Counsellorsandpsychotherapists.co.uk Limited registered in England and Wales with company number 08374436 and whose registered office is at Menta Business Centre, 5 Eastern Way, Bury St Edmunds, Suffolk, IP32 7AB.  Counsellorsandpsychotherapists.co.uk are also known as CounsellorsUK.


Intellectual Property Rights means all patents, registered and unregistered designs, copyright, trademarks, know-how and all other forms of intellectual property wherever in the world enforceable.


Member means any Practitioner accepted by Counsellorsandpsychotherapists.co.uk to be a member and whose name and details and information appears on the Website.


Website means www.counsellorsandpsychotherapists.co.uk.org or such other website as Counsellorsandpsychotherapists.co.uk might use in connection with the publication of a website.


Profile Information means name, address, telephone number, email address, training, qualifications and experience, areas of counselling, fees, membership organisations and proof of professionalism (proof of membership with a professional body or proof of qualifications and insurance cover).


Website User means a person using the Website.


3. Website Use


3.1 You accept that the inclusion of a practitioner’s details on the Website does not in any way constitute a warranty, representation, reference, validation or in any way an endorsement of any information to you, the Website User or any warranty, representation, recommendation or endorsement of the Member or services offered by the Member. An entry does not mean Counsellorsandpsychotherapists.co.uk warrants, represents or endorses the qualifications or professionalism of the Member.


3.2 You accept that the Profile Information is information provided by the Members to the Website. Whilst Counsellorsandpsychotherapists.co.uk may (but is not subject to an obligation) check with professional bodies to ensure that the Profile Information is correct and up to date at the time, and will carry out a check of Profile Information given at the time the Member’s subscription initially begins, the liability for providing accurate Profile Information remains on the Member and Counsellorsandpsychotherapists.co.uk specifically and expressly does not accept any liability for the accuracy of the Profile Information.


3.3 You accept that it is your duty to verify the Profile Information before relying on it. Details of the professional bodies can be found at http://www.counsellorsandpsychotherapists.co.uk.org/page/professional-bodies/58.


Counsellorsandpsychotherapists.co.uk is not affiliated, associated, authorised, endorsed, funded, or in any way officially connected by these professional bodies and the content of the Website does not represent the views of these professional bodies.  The names and logos of the professional bodies used on the Website are trademarks or registered trademarks of those professional bodies.


3.4 You further accept that Counsellorsandpsychotherapists.co.uk shall bear no liability or responsibility for the counselling service given by any Members or actions taken by you as a result of that counselling service.


3.5 Counsellorsandpsychotherapists.co.uk is not responsible for and does not endorse or make a representation in respect of any content or information published or Links to other websites which may appear on the Website.


3.6 The information displayed by Counsellorsandpsychotherapists.co.uk on the Website is a register for qualified professionals from the main professional bodies in the UK and is for information purposes only. It is not intended in any way to be a substitute for medical advice or the advice of any other healthcare professional. Counsellorsandpsychotherapists.co.uk is not responsible for any decisions or diagnoses which might be based upon any content published on the Website.


3.7 You expressly agree that you will not sell or trade in any materials on the Website or re-distribute these in any way or for any purpose including the compiling of any databases, lists or directories or providing commercial information to any third party or any commercial or other reason.


3.8 You agree that the Website is provided for personal use only for those wishing to engage the services of a Member. You agree not to use the Website for commercial purposes including contacting Members to promote your goods or services.


3.9 Counsellorsandpsychotherapists.co.uk shall not be liable for any interruption or temporary or otherwise shut down of the Website or any omissions, interruptions, suspension or deletion of emails.


3.10 Counsellorsandpsychotherapists.co.uk does not guarantee the security of any information transmitted over the Internet.


3.11 You accept that any call to any telephone numbers listed on this Website may be recorded for security purposes.


3.12 For the purpose of insurance only, Counsellorsandpsychotherapists.co.uk Limited are Introducer Appointed Representatives of Balens Limited, 2 Nimrod House Sandys Road Malvern WR14 1JJ, who are authorised and regulated by the Financial Conduct Authority. Counsellorsandpsychotherapists.co.uk corporate insurance advertising prices are subject to being correct at the time of going to print and discounts are based on the prices of equivalent cover at publication date.


4. Intellectual Property


4.1 Unless otherwise stated, the Intellectual Property Rights in all material on the Website (including without limitation photographs and graphical images) are owned by Counsellorsandpsychotherapists.co.uk or its licensors. For the purposes of these Terms, any use of extracts from the Website other than in accordance with clause 4.2 for any purpose is prohibited. If you breach these Terms, your permission to use the Website automatically terminates and you must immediately destroy any downloaded or printed extracts from the Website.


4.2 Any redistribution or reproduction of part or all of the contents of the Website in any form is prohibited other than the following:

5. Complaints Procedure


5.1 Notwithstanding that you accept that Counsellorsandpsychotherapists.co.uk has not validated, endorsed or accepted liability for the Profile Information, if you have any matters which you would wish to bring to the attention of Counsellorsandpsychotherapists.co.uk following your contact with any of the Members, these may be put forward to Counsellorsandpsychotherapists.co.uk via email to info@counsellorsandpsychotherapists.co.uk.org or by post to Menta Business Centre, 5 Eastern Way, Bury St Edmunds, Suffolk IP32 7AB.


5.2 You also understand that, should Counsellorsandpsychotherapists.co.uk receive any complaint from you, Counsellorsandpsychotherapists.co.uk is entitled to request further information from you, but is not under any obligation to investigate further or to take any particular action, or at all, against the particular Member. Counsellorsandpsychotherapists.co.uk shall have the right (but is not subject to an obligation) to send a copy of any complaint to the professional body/bodies the Member is governed by and have the right (but is not subject to an obligation) to remove a Member should a complaint or an investigation by the professional body be upheld.

If you become a Member of Counsellorsandpsychotherapists.co.uk you are agreeing to comply with and be bound by the following terms and conditions of use.


The term “Counsellorsandpsychotherapists.co.uk” or “us” or “we” refers to the owner of the Website whose company number is 08374436 and whose registered office is Menta Business Centre, Eastern Way, Bury St Edmunds, Suffolk, IP32 7AB, England. The term “you” refers to a current Member of Counsellorsandpsychotherapists.co.uk.


1. Membership


  1. New Members may upload their details to the Website however they must be a current member of:


  • British Association for Counselling and Psychotherapy (BACP);
  • United Kingdom of Psychotherapy (UKCP);
  • British Psychological Society (BPS)
  • College of Sexual and Relationship Therapists (COSRT)
  • British Association of Art Therapists (BAAT)
  • Counselling and Psychotherapy in Scotland (COSCA);
  • Irish Association for Counselling and Psychotherapy (IACP)
  • British Association for Behavioural and Cognitive Psychotherapies (BABCP) Accredited or Pre Accredited only
  • Association for Christian Counsellors (ACC)
  • British Association for Music Therapy (BAMT)
  • British Association of Drama Therapists (Badth)
  • British Association for Psychoanalytic and Psychodynamic Supervision (BAPPS)
  • British Psychoanalytic Council (BPC)
  • Association of Child Psychotherapists (ACP)


1.2 Other professional bodies may approach Counsellorsandpsychotherapists.co.uk for inclusion of their Members, however it is subject to them meeting our strict criteria on training, ongoing CPD and supervision.


1.3 At the time of registration, Members will be checked against the individual professional body registers online or by telephone.


1.4 We may request MBACP membership category send copies of their qualifications, insurance and supervisors details to Counsellorsandpsychotherapists.co.uk – if the course attended does not meet our criteria we have the right to remove the Member from the Website without notice.


1.5 It is the Member’s responsibility to keep their Profile Information up to date. You agree to update your Profile Information within 7 days of the change occurring. In the event Counsellorsandpsychotherapists.co.uk is notified or becomes aware that you have not updated and properly monitored your Profile Information in accordance with these Terms, Counsellorsandpsychotherapists.co.uk may, in its sole discretion, remove your Profile Information and suspend your membership.


1.6 Counsellorsandpsychotherapists.co.uk may check the disciplinary records of the professional bodies and if a Member is found to be suspended after an investigation and a complaint is upheld, Counsellorsandpsychotherapists.co.uk shall have the right, but is not under any obligation, to remove the Member from the Website and their membership suspended without notice.


1.7 In the event Counsellorsandpsychotherapists.co.uk receives any complaint by a Website User, which, upon reasonable enquiries appears in Counsellorsandpsychotherapists.co.uk's sole discretion to be genuine, Counsellorsandpsychotherapists.co.uk may refer the matter to you for your input, or may without reference to you, remove your Profile Information.


2. Payment and Fees


2.1 Payment can be made by cheque, credit or debit card (American Express is not accepted) or Paypal.


2.2 All payment details (including whether the Member wishes to pay monthly or annually) must be entered in full at the time of the Member’s Profile Information being uploaded to the Website. Recurring payments are set up at the time of entering your membership details and will be taken on the anniversary date of your membership starting with Counsellorsandpsychotherapists.co.uk, whether that be monthly or annually.


2.3 All membership fees exclude VAT (at present) and can change with prior notice of 30 days.


2.4 Invoices can be requested from counsellorsandpsychotherapists.co.uk if they are not available to download and print from the Member’s area.


 2.5 Refunds are not permitted for previous months.


2.6 Counsellorsandpsychotherapists.co.uk reserves the right to take catch up payments where payment is late or has been previously declined and in the event that any monthly or annual fee is not paid within 14 days of the due date, you agree to pay interest at a rate of 4% above the base rate of Co-op Bank plc compounded monthly from the due date until payment.  You further agree that should any fee remain outstanding for 30 days or more after the Due Date then Counsellorsandpsychotherapists.co.uk has the right to terminate your membership with immediate effect and remove your name and Profile Information from the Website.  In such cases the full amount of the outstanding fees shall remain due and owing and shall accrue interest in accordance with this clause.


2.7 When you make payment using credit/debit card, your payment details will be entered on the Website but shall remain secure and private. A secure server is used to protect your information. When you enter payment details on the Website the locked padlock symbol in the bottom right hand corner is displayed, which means the Website is secure and private information can be sent safely.  Counsellorsandpsychotherapists.co.uk uses Paypal for its card processing facilities, who are located in the UK. As Counsellorsandpsychotherapists.co.uk is a UK based website only GBP (£) is accepted when processing your membership fees.


2.8 No payment will be taken from your account until your Profile Information (in full or in part) appears on the Website.  If your application is unsuccessful, you will not be charged.


3. Termination


3.1 Subject to clause 3.4, either party may terminate the membership by giving 30 days’ prior notice.  All association with Counsellorsandpsychotherapists.co.uk must be removed from the Member’s correspondence.  All cancellation requests must be received in writing membership@counsellorsandpsychotherapists.co.uk.org.


3.2 Fees during that notice period shall still be payable up until the expiry date of the notice period and any payment due to be made by you during that notice period will still be taken by Counsellorsandpsychotherapists.co.uk. This applies whether you are paying monthly or annually.  For the avoidance of doubt any payment even if received after Notice is given, will be retained by Counsellorsandpsychotherapists.co.uk.


3.3 No refund of any monthly or annual subscriptions will be made despite cancellation pursuant to this clause.


3.4 Termination may be made by Counsellorsandpsychotherapists.co.uk on immediate written notice in the event of a material breach of these Terms by the Member or if payment is not made within the time stipulated in clause 2.6.


3.5 On termination of your membership or these Terms for any reason:


  • you shall immediately pay to Counsellorsandpsychotherapists.co.uk all of Counsellorsandpsychotherapists.co.uk's outstanding unpaid invoices and interest and, in respect of services supplied but for which no invoice has been submitted, Counsellorsandpsychotherapists.co.uk shall submit an invoice, which shall be payable by you immediately on receipt;
  • the accrued rights, remedies, obligations and liabilities of the parties as at expiry or termination shall not be affected, including the right to claim damages in respect of any breach of the Terms which existed at or before the date of termination or expiry; and
  • clauses which expressly or by implication have effect after termination shall continue in full force and effect.


4. Cookies Policy


4.1 Counsellorsandpsychotherapists.co.uk uses cookies to collect and store information about your usage on the Website. To view further information on this, please see our Privacy policy and cookies page.


5. Further Information on the Website and Links


5.1 In addition to your Profile Information on the Website and any other specific information, you are entitled to publish articles, advertise events, seminars or workshops, and publish information of promotions or special offers once registered on the Website. Counsellorsandpsychotherapists.co.uk reserves the right to decide not to publish this information.  You agree that the information will be accurate at the time it is given and should there be any change in any of the information, you agree that you will advise Counsellorsandpsychotherapists.co.uk of the change within 7 days of the change being effected.


5.2 You expressly agree that you will not sell or trade in any materials on the Website or re-distribute these in any way or for any purpose including the compiling of any databases, lists or directories or providing commercial information to any third party or any commercial or other reason.


5.3 Any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. Counsellorsandpsychotherapists.co.uk is not responsible for any content or information published or Links to other websites which may appear on the Website. Counsellorsandpsychotherapists.co.uk and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.

5.5 Counsellorsandpsychotherapists.co.uk shall fully co-operate with any law enforcement authorities or court order requesting or directing it to disclose the identity or locate anyone posting any material in breach of clauses 5.3 or 5.4.

6.3 We may periodically send you promotional emails about upcoming events, CPD’s or other information which we think you may find interesting using the email address you have provided.  You may opt out of this at any time by sending an email optout@counsellorsandpsychotherapists.co.uk.org.  No details will be passed to third parties.


7. Limitation of liability


7.1 Counsellorsandpsychotherapists.co.uk expressly excludes all responsibility and liability for the accuracy or otherwise of the Profile Information and shall have no liability whatsoever in the event that a Website User shall claim to be misinformed or suffer any loss or costs or hardship as a result of relying on, acting upon the information provided by you and appearing on the Website.


7.2 Notwithstanding the generality of the above clause, Counsellorsandpsychotherapists.co.uk shall specifically not be responsible for the accuracy or otherwise of the Profile Information, the updating of it or the content in any way, which shall at all times remain your liability.


7.3 Counsellorsandpsychotherapists.co.uk shall not be liable for any interruption or temporary or otherwise shut down of the Website or any omissions, interruptions, suspension or deletion of any files or Profile Information. 7.5 Counsellorsandpsychotherapists.co.uk, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website or your downloading of any material from the Website or any websites linked to the Website.


7.6 Nothing in these Terms shall limit or exclude the Counsellorsandpsychotherapists.co.uk’s liability for:


  • death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;
  • fraud or fraudulent misrepresentation; or
  • breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).


7.7 Subject to clause 7.6:


  • Counsellorsandpsychotherapists.co.uk shall under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit, or any indirect or consequential loss arising under or in connection with the Website; and
  • Counsellorsandpsychotherapists.co.uk’s total liability to you in respect of all other losses arising under or in connection with the Website, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the amount paid by you to Counsellorsandpsychotherapists.co.uk as a Member in the previous 12 months.


7.8 The terms implied by sections 3 to 5 of the Supply of Goods and Services Act 1982 are, to the fullest extent permitted by law, excluded from the Terms.


7.9 This clause 7 shall survive termination of the membership or the Terms.


8. Website Terms and Conditions


8.1 You acknowledge that Counsellorsandpsychotherapists.co.uk maintains its own Terms and Conditions on the Website to be used by the general public and all users of the Website (Terms and Conditions – for both Members and general public – see above), including people specifically looking for Practitioners or people browsing the internet.  By viewing the Website or becoming a Member of Counsellorsandpsychotherapists.co.uk, you acknowledge that you have read these Terms and Conditions and agree to conduct yourself and your part of the Terms in a manner so as to allow those Terms and Conditions to be complied with.


8.2 These Terms apply to the Website to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.


8.3 These Terms and use of this Website shall be made subject to the laws of England which shall exclusively govern the interpretation, application and effect of all permissions, exclusions, licences, policies and conditions of use set out in this Website.  The Courts of England shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of, or in connection with, these Terms, this Website and its use.  Both parties hereby consent to the admissibility of electronic evidence before the Courts of England.
